Q. What NCAA regulations govern the relationship between student athletes and agents?

Q. What NFLPA and Collective Bargaining Agreement regulations govern contact between an agent and a student athlete?

A. A certified contract advisor may not communicate directly or indirectly with a prospective player who is ineligible for the draft. Pursuant to the Collective Bargaining Agreement Article XVI Section 2(a) a player shall not be eligible for the draft until three NFL regular seasons have begun and ended following either his graduation from high school of graduation of the class with which he entered high school, whichever is earlier.


Q. Are you an NFLPA certified contract advisor?

A. Yes. Dudley Morton received his certification from the NFLPA in September 2008.


Q. Do you have a law degree?

A. Yes. Both Ryan Clement and Dudley Morton graduated from law school. Dudley Morton graduated from the University of Denver College of Law. Ryan Clement is a graduate of the University of Miami(FL) School of Law.


Q. Have you ever been implicated or investigated for any violations of NCAA or professional league rules?

A. No. Many of the people associated with ESM are former professional and student athletes. As such, ESM is acutely aware and highly respectful of all NCAA and professional league rules and regulations.


Q. What services do you offer to your clients other than contract negotiations (financial planning, tax advice, marketing, etc.)?

Q. Who will be negotiating my contract?

A. As a certified contract advisor and licensed attorney Dudley Morton will primarily be responsible for negotiating client contracts.

Q. What is your fee structure?

A. Pursuant to the rules and regulations promulgated by the NFLPA the maximum allowable fee for negotiating a player contract is 3%.


Q. How and when are you to be paid?

A. ESM generates detailed weekly statements during the NFL season reflecting fees owed for services performed for each of our clients.


Q. If I am likely to be a free agent, how can you help maximize my chances of making a team?

A. ESM uses its relationships with scouts, player personnel and other NFL executives to aggressively market every client.


Q. Do you have any connections with the UFL, CFL, or the Arena Football League?
